Welcome to Brownies Now!. By accessing our website, placing an order, or purchasing our products, you agree to the following Terms of Service. Please read them carefully before ordering.

1. General

By using this website, you confirm that you are at least 18 years old or have permission from a parent or guardian. We reserve the right to update or change these Terms of Service at any time without prior notice. Continued use of the website constitutes acceptance of any changes.

2. Products & Descriptions

All products are handmade and baked fresh to order.
Product images and descriptions are provided as accurately as possible; however, slight variations in appearance may occur due to the handmade nature of our brownies.
We reserve the right to modify or discontinue products at any time without notice.

3. Orders & Payments

All prices are listed in Australian Dollars (AUD) and include GST unless stated otherwise.
Full payment is required at the time of ordering.
We reserve the right to refuse or cancel any order at our discretion, including due to availability, pricing errors, or suspected misuse.

4. Delivery (Metro Melbourne Only)

All deliveries are completed by us within Metro Melbourne.
Delivery timeframes provided are estimates and may vary due to traffic, weather, or unforeseen circumstances.
It is the customer’s responsibility to ensure delivery address details are correct.
We are not responsible for orders delivered to an incorrect address provided at checkout.

Once an order has been delivered to the nominated address, responsibility for the product transfers to the customer.

5. No Refunds for Address Errors or Delivery Delays

We do not offer refunds or replacements for incorrect or incomplete address information supplied by the customer.
Delivery delays caused by circumstances outside our control do not qualify for refunds.

6. Returns & Refunds

Due to the perishable nature of our products, all sales are final.
We do not accept returns.
Refunds or replacements may only be offered in cases of damaged or incorrect orders, provided we are contacted within 24 hours of delivery with supporting photos.

7. Dietary Requirements & Allergens

We may offer dietary-friendly options upon request; however, all products are made in a kitchen that handles gluten, dairy, nuts, and other allergens.
We cannot guarantee an allergen-free environment.
It is the customer’s responsibility to assess whether our products are suitable for their dietary needs.

8. Cancellations

Orders may only be cancelled within a short window after purchase and before preparation has begun.
Custom, personalised, or event orders cannot be cancelled once production has started.

9. Intellectual Property

All content on this website, including text, images, logos, branding, and designs, is the property of Brownies Now! and may not be copied, reproduced, or used without written permission.

10. Limitation of Liability

To the maximum extent permitted by law:

We are not liable for any indirect, incidental, or consequential damages arising from the use of our website or products.
Our total liability is limited to the value of the order purchased.

Nothing in these terms excludes your rights under Australian Consumer Law.

11. Governing Law

These Terms of Service are governed by the laws of Victoria, Australia, and any disputes will be handled within that jurisdiction.
